Kuraiender is a vtuber and adopt artist (they/them) whose design is inspired by Japanese Decora, American Y2K (aesthetic) and Core-Core (lore). They are chronically ill and their multiple diseases make it difficult to pursue their artistic dreams. Despite their snail pacing, Ender hopes to finally make their debut to the vtuber space within the next year.

.ONE. Introduction
By purchasing art or adoptables from Kuraiender, you agree to the following Terms of Service. These Terms outline the rights and responsibilities of both the Buyer and the Seller. Please read these Terms carefully before making a purchase..TWO. Rights and Ownership
2.1 Intellectual Property: Upon purchase, the Buyer receives the right to use the Art or Adopt for personal use. This includes, but is not limited to, displaying the character on social media, creating artwork, and developing backstories.
2.2 Commercial Rights: The Buyer may not use the Art or Adopt for commercial purposes, such as selling merchandise or using the character or artwork in commercial projects. If commercial usage rights are desired by the Buyer, they must be purchased for x2 the original price. In the case where a design or artwork has been given for free, commercial rights may be bought for a flat rate of $30 at any time. Otherwise, the freebie may ONLY be used for personal projects and purposes.
2.3 Credit: The Buyer must credit Kuraiender as the original creator of the Illustration or Adoptable in any public use, including but not limited to artwork, stories, online profiles, and social media.
2.4 Alterations: The Buyer is permitted to make minor changes or alterations to the Adopt or Illustration. Any significant changes should be discussed prior with Kuraiender.
2.5 Resale and Transfer: The Buyer may resell or transfer the Adopt to another party. If resold or transferred, the new owner must also agree to these Terms, and Kuraiender must be informed of the new owner's information..THREE. Payment and Refunds
3.1 Payment: All payments must be made in full before the transfer of ownership of the Adopt or Commissioned Illustration. Accepted payment methods include Paypal, Ko-Fi, etc. Check in advance if your preferred payment method is accepted.
3.2 Refunds: All sales are final. No refunds will be issued after the Adopt has been transferred to the Buyer or when the Commission has been started, except under specific circumstances, such as a breach of these Terms by the Seller.

.FOUR. Delivery
4.1 Digital Delivery: HD files for the Adoptable will be delivered digitally to the Buyer via email, download link, etc. within 24 hours after payment is received.
4.2 No Physical Items: No physical items will be shipped. The purchased items include only digital artwork and associated rights as described in these Terms..FIVE. Breach of Terms
5.1 Breach: Any breach of these Terms may result in the forfeiture of rights to the Adoptable without a refund. The Seller reserves the right to take appropriate legal action in case of unauthorized use or breach..SIX. Disclaimer
6.1 No Liability: The Seller is not liable for any damages or losses resulting from the use of the Adopt or Illustration. The Buyer assumes all responsibility for the use and portrayal of the purchased Artwork. Including, the buyer’s responsibility to properly store the digital files..SEVEN. Amendments
7.1 Changes to Terms: The Seller reserves the right to amend these Terms at any time. Any changes will be communicated to the Buyer via email, website, etc. Continued use of the Adopt signifies acceptance of any updated Terms..EIGHT. Governing Law
